Se**al Assault Charges Dismissed
His three day trial was supposed to begin this morning in Dartmouth, but the Crown told the court it would not be presenting any evidence. Judge Jill Hartlen then dismissed the case.
Smith had pleaded not guilty to one count of se**al assault stemming from an alleged incident in 2017.
His lawyer says Smith is pleased with the dismissal and wants to put the matter behind him. Trailer Park Boys Inc. says Smith will now resume his responsibilities with the company.
Smith, 54, plays Bubbles on the highly popular satirical comedy. He pleaded not guilty in February.
The complainant, whose identity is protected by a publication ban, told CBC ahead of the trial that she had decided not to testify because of the emotional toll the process would take on her.
In a statement, she criticized the experience faced by complainants in se**al assault trials, saying survivors can be subjected to intense scrutiny and cross-examination. She said her decision to step away from the case was about protecting her mental health.
The Crown prosecutor did not confirm that the complainant’s decision was the reason no evidence was offered.
After the Crown presented no evidence, Smith’s defence requested that the charge be dismissed. Judge Jill Hartlen granted the request.
Trailer Park Boys Incorporated issued a statement Thursday saying that, with the court matter concluded, Smith will resume his responsibilities with the company. He previously served as managing director.
